Service of Process by Publication
Pursuant to the order of the Circuit Court, comes now the Plaintiff in the above styled action and does hereby perfect service of process by publication pursuant to Rule 4.3 of the Alabama Rules of Civil Procedure against the following Defendants:
• Unknown heirs of Geraldine Ball, deceased, who was wife of Claude Earl Ball, deceased;
• Connie Cammack
• Theodore McMullen
• Kendrick McMullen
• Theodore McMullen III
• Corinthian McMullen
• Kenneth McMullen
• Anthony McMullen
According to the requirements of Rule 4.3(d)(3) of the A.R.C.P., the Plaintiff does hereby state as follows:
That this action is a partition action to quiet title to the property listed below, which originally was owned in fee simple by Theodore McMullen, deceased. The said Theodore McMullen died intestate, survived by 8 children, namely, Isola Artis (living), Lucian McMullen (living), Aquilla Pender (living), Leola White (living), Fannie Mae Ball (deceased), Ruberta Cammack (deceased), James Porter McMullen (deceased) and Theodore McMullen Jr., (deceased). Of those deceased children of Theodore McMullen, the Defendants listed herein to be published against for service of process, are heirs by intestate succession. The said property located in Pickens County, Alabama, is as follows:
“Begin at the Southwest corner of Southwest Quarter of Northwest Quarter of Section 16, Township 22, Range 16 West, and run North 87 degrees 55 minutes East 5.20 chains, thence North 5 degrees West 15 chains, thence South 87 degrees 55 minutes West 14.80 chains, thence South 5 degrees East 15 chains, thence North 87 degrees 55 minutes East 9.60 chains to point of beginning, said tract containing 22.25 acres, more or less, being 7.8 acres off the West side of 20 acres owned by John McMullen in SW ¼ of NW ¼, Section 16, and 14.45 acres off East side of the 30 acres off South side of SE ¼ of NE ¼ of Section 17.”
The Defendants listed hereinabove are notified that they are required to answer this complaint within thirty (30) days of February 21, 2024, which is the last date of publication of this service of process.
