PICKENS COUNTY
RESOLUTION OF THE PICKENS COUNTY COMMISSION
WHEREAS, voters will soon consider Amendment 1, which will be on the ballot during the 2024 Primary Election held on March 5, 2024; and
WHEREAS, the Legislature regularly passes local laws and local constitutional amendments that impact the services provided to the county’s residents, as well as the mechanisms for funding these services; and
WHEREAS, some of these taxpayer-funded services include law enforcement, education, fire protection, ambulance services, the regulation of alcoholic beverages, and economic development; and
WHEREAS, since 1984, the Alabama Constitution has required that no legislation be considered by the Legislature until both of the State’s annual budgets are passed and delivered to the Governor; and
WHEREAS, there is an exception that allows the Legislature to consider other matters ahead of the budgets by adopting a “Budget Isolation Resolution” (BIR) by a vote “of not less than three-fifths of a quorum present”; and
WHEREAS, the language of this exception has been interpreted various ways since 1984 and has generated lawsuits in recent years over how many votes are needed to adopt a BIR; and
WHEREAS, if a court finds that a local law’s BIR was adopted improperly, it could result in that local law being challenged on procedural grounds, even if the local law otherwise passed both chambers and became law; and
WHEREAS, Amendment 1 would allow local bills and local constitutional amendments to be considered by the Legislature without the adoption of a BIR, removing a procedural step from the legislative process; and
WHEREAS, the Association of County Commissions of Alabama has adopted a resolution encouraging Alabamians to vote yes to Amendment 1 on March 5, 2024.
NOW, THEREFORE BE IT RESOLVED BY THE PICKENS COUNTY COMMISSION that it encourages the citizens of the county to go to the polls on March 5, 2024, and make their voices heard on Amendment 1.

Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Cody Landon Prescott and Tristen Mae Danielle Prescott, originally in favor of Mortgage Electronic Registration Systems, Inc., as nominee for West Alabama Bank & Trust, on March 2, 2018, said mortgage recorded in the Office of the Judge of Probate of Pickens County, Alabama, in Mortgage Book 338, Page 565; the undersigned Lakeview Loan Servicing, LLC, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Pickens County, Alabama, on March 21, 2024, during the legal hours of sale, all of its rights, title, and interest in and to the following described real estate, situated in Pickens County, Alabama, to-wit:

Begin at the point of intersection of the East boundary line of the Northwest Quarter of the Southwest Quarter of said Section 14 with the South right-of-way margin of Alabama Highway No. 6 and proceed in a westerly direction and along said south right-of-way margin for a distance of 210.30 feet to a point; thence with an interior angle right of 86 degrees 56 minutes 33 seconds run in a southerly direction for a distance of 411.22 feet to a point; thence with an interior angle right of 90 degrees 00 minutes 00 seconds run in an easterly direction for a distance of 273.00 feet to a point; thence with an interior angle right of 89 degrees 04 minutes 17 seconds run in a northerly direction for a distance of 193.81 feet to a point; thence with an interior angle right of 96 degrees 54 minutes 46 seconds run in a westerly direction for a distance of 18.42 feet to a point; thence with an interior angle right of 269 degrees 45 minutes 00 seconds run in a Northerly direction for a distance of 199.88 feet to a point on the South right-of-way margin of said highway; thence with an interior angle right of 89 degrees 18 minutes 07 seconds run in a westerly direction and along the South right-of-way margin of said highway for a distance of 61.75 feet to the POINT OF BEGINNING, forming an interior closure angle of 178 degrees 01 minutes 17 seconds.
Said legal description being controlling, however the property is more commonly known as: 438 Coal Fire Circle, Reform, AL 35481.
THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.
