Default having been made of the terms of the loan documents secured by that certain mortgage executed by George Jones, Jr And Michelle Lee Jones Husband And Wife to Realty Mortgage Corporation dated September 30, 1998; said mortgage being recorded on October 2, 1998, in Book 112, Page 632 in the Office of the Judge of Probate of Pickens County, Alabama. Said Mortgage was last sold, assigned and transferred to Citibank, N.A., as trustee for CMLTI Asset Trust to be recorded in the Office of the Judge of Probate of Pickens County, Alabama.
The undersigned, Citibank, N.A., as trustee for CMLTI Asset Trust, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the main entrance of the Court House in Pickens County, Alabama during the legal hours of sale (between 11am and 4pm), on the 23rd day of February, 2023 the following property, situated in Pickens County, Alabama, to-wit:
A parcel of land in the Northwest Quarter of the Northeast Quarter of Section 6, Township 19 South, Range 16 West, Pickens County, Alabama, being more particularly described as follows: Commence at the Northwest corner of said Northwest Quarter of the Northeast Quarter; thence East and along the North line of said Quarter a distance of 419.02 feet to the point of beginning; thence continue Eastwardly and along said North line, a distance of 341.94 feet to the point of intersection with the West right-of-way margin of an unimproved county road; thence with an interior angle of 56 degrees 53 minutes southwestwardly and along said West margin a distance of 179.09 feet; thence with an interior angle of 123 degrees 07 minutes westwardly and parallel to the North line of said Northwest Quarter of the Northeast Quarter a distance of 238.86 feet; thence with an interior angle of 92 degrees 00 minutes northwardly a distance of 150.09 feet to the point of beginning; making an interior closure angle of 88 degrees 00 minutes. Said parcel of land contains one (1.00) acre, more or less.
Said property is commonly known as Rt 1 Box 509, Ethelsville, AL 35461.
Should a conflict arise between the property address and the legal description the legal description will control.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record including, but not limited to, those superior to said Mortgage first set out above. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The successful bidder must present certified funds in the amount of the winning bid at the time and place of sale.
