Default having been made in the payment of indebtedness secured by that certain mortgage executed by Christopher Maurice Bonner and wife, Alicia Jones Bonner, on January 7, 1997, to Security Federal Bank, predecessor of SmartBank, which said mortgage was filed and recorded on January 10, 1997, in Book 93, Page 645, in the Probate Office of Pickens County, Alabama, and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, SmartBank, will sell at public outcry, for cash, to the highest bidder, in front of the Courthouse door, in Carrollton, Pickens County, Alabama, during the legal hours of sale on the 18th day of January, 2023, the following described real estate situated in Pickens County, Alabama, to-wit:
Begin at the northwest corner of the lot owned by Boyd Edgeworth, as shown on plat recorded in Deed Book 62, Page 11 in the Probate Office of Pickens County, Alabama, said rod being the Point of Beginning; thence run S 89 degrees, 23 minutes 49 seconds W for a distance of 192.72 feet to an iron rod located on the East right of way margin of 4th Street N. W., also called West Russell Street, as shown on said plat, said rod being 41.50 feet from a lightning rod shown on plat recorded in Deed Book 62, Page 11 in the Probate Office of Pickens County, Alabama; thence run S 8 degrees 21 minutes 03 seconds E along said right of way for a distance of 144.00 feet to an iron rod located on the North right of way margin of 4th Ave. N. W.; thence run S 89 degrees 05 minutes 08 seconds E along said right of way for a distance of 174.80 feet to an iron rod; thence run N 1 degree 09 minutes 35 seconds W for a distance of 147.32 feet to the point of beginning. Said parcel lying in the Southwest Quarter of the Southeast Quarter of Section 20, Township 19 South, Range 14 West, Pickens County, Alabama and contains 0.6 acres more or less.
Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
Said property will be sold on an "AS IS, WHERE IS" basis subject to the right of way easements and restrictions of record in the Probate Office of Pickens County, Alabama, and will be subject to any existing special assessments which might adversely affect the title to subject property. Said sale will be made for the purpose of paying the indebtedness secured by the said mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage.
